Louisiana accident leaves Colfax motorcyclist dead

A 44-year-old man was killed in a motorcycle accident in Grant Parish on Nov. 10. According to law enforcement authorities, the 8:45 a.m. accident occurred on Louisiana Highway 8 near Bentley and involved a Ford pickup truck and a Harley-Davidson motorcycle.

The driver of the pickup truck, a 31-year-old man, was traveling west on the highway when he attempted to turn left and entered into the path of the motorcycle. The consequent collision claimed the life of the 44-year-old motorcyclist, whom was pronounced dead at the scene of the accident.

Reportedly, the driver of the Ford was wearing a seat belt when the crash occurred. Authorities said he survived the event without injury. However, law enforcement officials charged the 31-year-old man with failure to yield.

Furthermore, routine toxicology tests were performed to determine whether impairment was a factor in the crash. The results are still pending, authorities stated. In any event, the results of the ongoing police investigation may impact whether the family of the deceased motorcyclist pursues a civil lawsuit in relation to the wreck. For, the investigation may provide definitive answers as to what factors contributed to the accident and who was at fault. If, say, distracted driving were to be identified as a major contributory factor in this incident, then there may be grounds for civil action citing negligence. According to authorities, inattentive driving is a leading cause of accidents in Louisiana.

A wrongful death lawsuit is one type of civil action that may be filed in association with a fatal motorcycle accident. Typically, certain immediate family members of the accident's victims file this type of lawsuit as a mechanism for eliciting accountability for the accident and for obtaining restitution for pecuniary and noneconomic damages suffered as a consequence of the fatal event.
