A Louisiana woman has filed a lawsuit claiming she was injured when the bus she was riding in was hit by another vehicle on April 15. She is seeking an unspecified amount in damages for mental distress, mental anguish and pain and suffering.
According to the court filing, the plaintiff was a passenger on a Jefferson Parish Transit bus when another vehicle struck it from behind in Gretna, causing her severe injuries that required medical treatment. The defendants include the case are Allstate Insurance, Jefferson Parish Transit, Transdev Services Inc., the bus driver and the driver of the vehicle that struck the bus.
The driver that hit the bus is accused of failing to maintain a proper distance from the bus, failing to keep the vehicle under proper control, failing to keep proper lookout, failing to see what could have been seen, driving in a reckless manner, failing to exercise reasonable vigilance, disobeying the rules of the road, failing to brake, failing to properly maintain the vehicle and failing to avoid the collision.
Anyone injured in a motor vehicle accident caused by a negligent driver may wish to consult with an attorney who handles these types of matters. Depending on the details of the case, it may be possible to file a civil lawsuit against the at-fault driver seeking compensation. The attorney could use police reports, accident reconstruction results, witness testimony and other evidence to demonstrate that the at-fault driver is responsible for a victim’s injuries. If the suit is successful, the plaintiff might be awarded damages for medical expenses, wages lost during the recovery period and pain and suffering.
