Car accident victim pursues claim against insurer

On Behalf of | Oct 12, 2015 | Car Accidents |

Louisiana residents that have been injured in a car accident that was caused by an uninsured motorist may be able to file a claim against their own insurer in order to recover compensation for damages. One man did just that after he was involved in a wreck on Nov. 23, 2014.

The man filed his claim in Jefferson County District Court on Sept. 17. He is suing State Farm Mutual Automobile Insurance Co. for financial compensation for his car crash injuries. The accident in question took place on Eastex service road in Beaumont and caused the plaintiff to sustain neck, back, shoulder and knee injuries. According to the complaint, the other motorist, who was uninsured, was determined to be at fault for the wreck.

The claim against State Farm seeks compensation for damages that include past and future medical bills, pain and suffering, loss of earning capacity and physical impairment. Monetary compensation for mental anguish and loss of enjoyment of life is also being sought. The man is also pursuing financial compensation under his insurance contract’s uninsured motorist clause.

Working with insurance providers after a car accident can be challenging, especially when the driver who was at fault was uninsured. A person who has been involved in an accident with an uninsured driver may want to have representation from an attorney while filing a claim for financial compensation. An attorney may be able to properly evaluate the accident victim’s financial losses so that the appropriate amount of damages can be pursued.
